    Conductor de Frio Camplillo multado con 6.000€ por no hacer los 45 min de descanso en doble

    • Un conductor de la empresa murciana "Frío Campillo" ha sido multado hoy en Francia con 6.000 euros por no hacer el descanso de 45 minutos en doble conducción.

      Se trata de la primera multa llegada hoy a redacción, con lo cual tal como ya se avisó precisamente ayer día 12 en un artículo compartido en este foro FRANCIA SANCIONA POR NO REALIZAR LA PAUSA CON EL CAMIÓN PARADO EN CONDUCCIÓN EN EQUIPO

      Además, desde el Departamento Jurídico de ASG Trans, se ha confirmado que en los últimos días se ha sancionado a varias empresas de transporte españolas en Francia por exceso de conducción ininterrumpida, debido a que las pausas de 45 minutos en los supuestos de doble conductor no se habían realizado con el vehículo parado.

      El artículo 7 del reglamento 561/2006 del parlamento Europeo de 15 de marzo de 2006 establece “Tras un período de conducción de cuatro horas y media, el conductor hará una pausa ininterrumpida de al menos 45 minutos, a menos que tome un período de descanso.

      Podrá sustituirse dicha pausa por una pausa de al menos 15 minutos seguida de una pausa de al menos 30 minutos, intercaladas en el período de conducción, de forma que se respeten las disposiciones del párrafo primero”

      Al imponerse una sanción por cada infracción detectada el importe de las sanciones puede llegar a ser muy elevado. Las sanciones de las que tenemos constancia hasta la fecha oscilan entre los 4.500€ y los 6.000 €.

    • We want to ask for an opinion about the 45 minutes break situation from France, when the drivers are involved in multi-manning driving. We are the largest consulting company specializing in legislative road in Romania and some of the transport companies we consult, often perform road transport activities in France. We read with interest your materials, appeared on the website http://www.forotransportistas.es ,about the controls in France, where some spanish carriers involved in multi-manning driving were fined, because they didn`t take the 45 minutes break after the 4:30 hours of continuous driving, and in our turn we analyzed this situation, by studying in the first place the Regulation (EC) 561/2006, the Regulation (EC) 165/2014 and the Regulation (EC) 3821/1985. In your materials, you make reference to certain modifications regarding this situation, that have occurred at the same time with the entering into force of Regulation (EC) 165/2014. Following the legal analysis of the provisions from the Regulation 165/2014, Article 34 (3) and Regulation 3821/06, Article 15 (3), there haven`t been found modifications that lead to a different interpretation. Also, the Guidance Note 2 clarifies certain aspects in this regard. The obligation to take the BREAK aboard an stationary vehicle doesn`t appear in Regulation (EC) 561/06. The obligation to take the REST BREAK aboard an stationary vehicle appears in Article 8, paragraph (8). There is the possibility that a french "specialist" (if these fines are confirmed) had compared the Regulation (EC) 165/2014 with the Regulation (EC) 3821/06 in the unconsolidated form. To conclude, everything that appeared online in these last days regarding this issue, does not have a legal basis, and may be arising from a mistake of interpretation. In this situation, we understand that you have corresponded with the responsible authorities in France and they confirmed the intimations made by your company. We also sent to the European Commission an address regarding this situation. However, we believe that an error has occurred. Can you send us more details regarding this issue?
